Terms of Service

1. The Service

Ship It Badger is a project tracking tool that helps you track side projects, predict ship dates, and stay accountable. We provide the service on a subscription basis.

2. Your Account

• You must provide accurate information when creating an account
• You're responsible for keeping your login credentials secure
• You're responsible for all activity under your account
• You must be at least 16 years old to use the service

3. Free Trial & Payment

• New accounts receive a 1-month free trial with full access
• After the trial, your subscription continues at the selected plan rate
• We require a payment method upfront; you won't be charged until the trial ends
• Payments are processed by Lemonsqueezy on our behalf
• All fees are in US dollars unless otherwise stated

4. Cancellation & Refunds

• You can cancel your subscription at any time from your account settings
• Cancellation takes effect at the end of your current billing period
• You retain access until your paid period ends
• No refunds are provided for partial months or unused time
• If you cancel during the free trial, you won't be charged

5. Your Data

• You own all content and data you upload to Ship It Badger ("Your Data")
• You grant us a license to store, display, and process Your Data solely to provide the service
• You can export Your Data at any time
• If you cancel your subscription, we aim to keep Your Data in a frozen state for up to 1 year when possible, but this is not guaranteed
• If you delete your account, we will delete Your Data within 30 days
• We don't sell your data or show you ads

6. Acceptable Use

You agree not to:

• Use the service for anything illegal
• Attempt to access other users' accounts or data
• Interfere with or disrupt the service
• Use automated tools to scrape or abuse the service
• Upload malicious code or content
• Resell or redistribute the service

We may suspend or terminate accounts that violate these rules.

7. Our Intellectual Property

• Ship It Badger, including its design, code, features, and branding, belongs to Shorewood Tech LLC
• You get a limited, non-exclusive license to use the service while your subscription is active
• You may not copy, modify, or reverse-engineer any part of the service

8. Service Availability

• We strive for high uptime but don't guarantee uninterrupted service
• We may update, modify, or discontinue features with reasonable notice
• Scheduled maintenance will be announced when possible

9. Limitation of Liability

The service is provided "as is" without warranties of any kind.

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months before the claim
• We are not responsible for data loss; you are responsible for maintaining backups

10. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the service or violation of these Terms.

11. Changes to Terms

• We may update these Terms from time to time
• We'll notify you of material changes via email or in-app notice
• Continued use after changes means you accept the new Terms

12. Termination

• You can close your account at any time
• We can terminate your account for violation of these Terms
• Upon termination, your right to use the service ends immediately

13. Governing Law

These Terms are governed by the laws of the State of Wisconsin, USA, without regard to conflict of law principles. Any disputes will be resolved in the courts of Wisconsin.
